Sides prepare for closing arguments in trial of former Keokuk County Sheriff’s Deputy David Heady
The defense opened its case Friday in the trial of former Keokuk County Sheriff’s Deputy David Heady, calling two witnesses, including truck driver Daniel Brubaker, at the Mahaska County Courthouse.
Brubaker, who was pulling a hayrack carrying about 25 to 30 children during the crash at issue in 2023, has pleaded guilty to similar charges.
Defense attorney Jeff Powell pressed jurors to place primary blame on Brubaker rather than Heady, who was a passenger in the truck.
Asked why he pleaded guilty, Brubaker replied, “Because I was driving.”
Brubaker testified that he had five drinks in the hours before the crash, adding at least half a large bottle of vodka in the hours after the crash in his office.
On cross-examination, Assistant Attorney General Frank Severino emphasized that both men had a duty to protect the children on the hayrack.
“You two shared responsibility for those kids — both failed those kids?” he asked. “Yes, sir,” Brubaker said. “You both failed those kids?” “Yes, sir.”
The judge denied two defense motions for a judgment of acquittal.
Closing arguments are expected Tuesday, after which the case will go to the jury.
