THIS THIS AFTERNOON, THE DEFENSE STARTED PRESENTING ITS CASE IN THE TRIAL OF A FORMER KEOKUK COUNTY DEPUTY, DAVID HEADY, CALLING TWO WITNESSES TO THE STAND. THE FIRST, DANIEL BRUBAKER. HE WAS THE ONE DRIVING THE TRUCK, PULLING THE HAYRACK RIDE. HE HAS PLED GUILTY TO SIMILAR CHARGES. vlog MARCUS MCINTOSH WAS INSIDE THE MAHASKA COUNTY COURTHOUSE AND HEARD WHAT BRUBAKER HAD TO SAY. DANIEL BRUBAKER TOOK THE WITNESS STAND FOR THE DEFENSE FRIDAY MORNING. DEFENSE ATTORNEY JEFF POWELL TRIED TO MAKE A CLEAR POINT TO THE JURY. THE FAULT IS ALL ON BRUBAKER, NOT THE DEFENDANT, DAVID HEADY. WHY DID YOU FEEL YOU WERE GUILTY IN THIS CASE? BECAUSE I FELT I WAS RESPONSIBLE AND BECAUSE I WAS THE DRIVER. POWELL TOOK BRUBAKER THROUGH HIS DRINKING IN THE HOURS BEFORE, AND WHEN HE WENT TO HIS OFFICE AFTER THE CRASH, I LEFT THERE AND WENT TO OUR OFFICE AND DRANK VODKA. HOW MUCH VODKA? PROBABLY A HALF A BOTTLE. WHAT DID YOU DO THAT I JUST WASN’T IN A GOOD PLACE. I FELT ABSOLUTELY HORRIBLE. ASSISTANT ATTORNEY GENERAL FRANK SERVINO TRIED TURNING THE TABLES, MAKING BRUBAKER ADMIT THE FAULT DOES NOT FALL SQUARELY ON HIS SHOULDERS. YOU’RE THE ONLY TWO PEOPLE THAT COULD HAVE TAKEN STEPS TO PREVENT THIS FROM HAPPENING. CORRECT? YES, SIR. YOU BOTH FAILED THE KIDS, DIDN’T YOU? YES, SIR. GOING FURTHER BY STATING THAT WITH HEADY BEING A PASSENGER IN THE TRUCK, BRUBAKER WAS DRIVING, BOTH MEN HAD A DUTY TO PROTECT THE 25 TO 30 KIDS ON THE HAYRACK RIDE. HE NEVER TOLD YOU TO SLOW DOWN, DID HE? NOT TO MY KNOWLEDGE. THE DEFENSE TWICE ASKED FOR JUDGMENT OF ACQUITTAL. BOTH MOTIONS WERE DENIED. CLOSING ARGUMENTS EXPECTED TUESDAY MORNING. THEN THE CASE GOES TO THE JURY IN OSKALOOSA.

The defense opened its case Friday in the trial of former Keokuk County Sheriff’s Deputy David Heady, calling two witnesses, including truck driver Daniel Brubaker, at the Mahaska County Courthouse. Brubaker, who was pulling a hayrack carrying about 25 to 30 children during the crash at issue in 2023, has pleaded guilty to similar charges.Defense attorney Jeff Powell pressed jurors to place primary blame on Brubaker rather than Heady, who was a passenger in the truck. Asked why he pleaded guilty, Brubaker replied, “Because I was driving.”Brubaker testified that he had five drinks in the hours before the crash, adding at least half a large bottle of vodka in the hours after the crash in his office. On cross-examination, Assistant Attorney General Frank Severino emphasized that both men had a duty to protect the children on the hayrack. “You two shared responsibility for those kids — both failed those kids?” he asked. “Yes, sir,” Brubaker said. “You both failed those kids?” “Yes, sir.”The judge denied two defense motions for a judgment of acquittal.
